Welcome to Guac-A-Mole! These Terms of Service ("Terms") govern your use of the Guac-A-Mole mobile game ("Game," "App," or "Service") operated by Guac-A-Mole ("we," "us," or "our").

By downloading, installing, or playing Guac-A-Mole, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, you may not use the Game.

2. License to Use

2.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Game on your personal devices
• Use the Game for personal, non-commercial entertainment purposes
• Access Game features according to these Terms

2.2 License Restrictions

You may NOT:

• ❌ Reverse engineer, decompile, or disassemble the Game
• ❌ Remove or alter any proprietary notices or labels

3. Account & Game Data

3.1 No Account Required

Guac-A-Mole does not require account creation. Your game progress is stored locally on your device and via anonymous player IDs for leaderboards.

3.2 Game Progress

• Local Storage: Progress, achievements, and Pitcoins are stored on your device
• No Guarantee: We don't guarantee data preservation if you delete the app or switch devices
• Backup: It's your responsibility to maintain device backups

4. In-App Purchases & Virtual Currency

4.1 Pitcoins (Virtual Currency)

• Pitcoins are virtual currency used within the Game
• Pitcoins have no real-world value and cannot be exchanged for money
• Pitcoins earned or purchased are non-refundable
• We may adjust Pitcoin pricing or availability at any time

4.2 Purchases

• All purchases are processed through Apple App Store or Google Play Store
• Refunds are subject to their respective store policies
• We are not responsible for unauthorized purchases made on your device

5. Acceptable Use

5.1 You Agree To:

• ✅ Use the Game for lawful purposes only
• ✅ Play fairly and respect other players
• ✅ Report bugs and security issues responsibly
• ✅ Respect intellectual property rights

5.2 Prohibited Conduct

You may NOT:

• Use cheats, exploits, automation software, bots, hacks, or mods
• Attempt to gain unauthorized access to Game systems
• Harass, abuse, or harm other players
• Upload or transmit viruses or malicious code
• Sell, trade, or transfer your Game progress
• Impersonate others or misrepresent your affiliation
• Violate any applicable laws or regulations

6. Leaderboards & Competition

6.1 Fair Play

• Leaderboard scores must be achieved through legitimate gameplay
• We reserve the right to remove suspicious or fraudulent scores
• Cheating may result in leaderboard bans

6.2 No Guarantees

• We don't guarantee leaderboard accuracy or availability
• Leaderboard data may be reset or modified at our discretion

7. Intellectual Property

7.1 Our Rights

All content in Guac-A-Mole, including but not limited to:

• Graphics, artwork, and visual designs
• Music, sound effects, and audio
• Game mechanics and code
• Trademarks and logos
• Text, dialogue, and copy

7.2 Your Rights

You may create and share:

• ✅ Screenshots and gameplay videos for personal, non-commercial use
• ✅ Fan art and creative works (with attribution)
• ✅ Reviews and commentary

You may NOT use our intellectual property for commercial purposes without written permission.

8. Updates & Modifications

8.1 Game Updates

• We may update the Game at any time
• Updates may add, modify, or remove features
• Continued use after updates means you accept the changes

8.2 Service Availability

• We strive to keep the Game available 24/7
• We may temporarily suspend service for maintenance
• We don't guarantee uninterrupted or error-free service

9. Termination

9.1 Your Rights

You may stop using the Game at any time by uninstalling it.

9.2 Our Rights

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in cheating or fraudulent activity
• Harm other players or the Game

10. Disclaimers

10.1 "As-Is" Basis

The Game is provided "AS-IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness

10.2 No Liability

To the fullest extent permitted by law, we are NOT liable for:

• Loss of data or progress
• Device damage or malfunction
• Indirect, incidental, or consequential damages
• Loss of profits or revenue
• Third-party actions or content

11. Limitation of Liability

Our total liability to you for any claims arising from the Game shall not exceed the amount you paid us in the 12 months before the claim (if any).

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the Game
• Your violation of these Terms
• Your violation of any laws or third-party rights

13. Children

Guac-A-Mole is rated 4+ and suitable for all ages. We do not knowingly collect personal information from children under 13 without parental consent. See our Privacy Policy for details.

14. Changes to Terms

We may update these Terms at any time. Changes will be effective when posted. Continued use after changes means you accept the updated Terms.

We'll notify you of significant changes via in-app notification or email (if you've provided one).

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

16. Dispute Resolution

16.1 Informal Resolution

Before filing a claim, please contact us at support@iscovici.com to try to resolve the issue informally.

16.2 Arbitration

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Game.
